Loterj challenges Brazil’s Supreme Court decision

Loterj has filed a new appeal with the Federal Supreme Court (STF) in response to the suspension of nationally operating bets in Rio de Janeiro.

The agency is seeking to overturn the decision made by Minister André Mendonça, which halted the national operations of bets licensed by Loterj. The appeal was submitted on Tuesday (7th).

In its recent appeal, Loterj underscores that the announcement questioned by the Attorney General’s Office (AGU) adhered to the legal standards that were in place at the time of publication and was subsequently revised.

Loterj contends that the provision restricting the operation of bets to a specific territory took effect with the introduction of Law 14.790/2023 and was not established or amended by Provisional Measure 1.182/2023. From the agency’s perspective, it would be “chronologically and logically impossible” to claim that the credentialing notice was in violation of the law, as the amendment was enacted six months before the law came into effect. According to Loterj, there was no breach of legal norms because such norms did not exist at that time. Mendonça’s injunction affects 25 companies authorized in Rio de Janeiro.

In his ruling Minister André Mendonça ordered Loterj and the State of Rio de Janeiro to stop accepting fixed-odds sports bets made outside their territory. The deadline for taking action was five days. In the injunction, Mendonça suspended the effectiveness of a rule from Loterj’s public notice for accrediting companies to operate bets in the state. For the minister, the measure favours the interstate exploitation of this public service by Rio de Janeiro, to the detriment of the competence of the Union and other states.
